Overview

Why Visa Condition 8105 — Work Limitation Explained?

Condition 8105 is a standard visa condition imposed by the Department of Home Affairs that limits the holder to 48 hours of work during any fortnight (14-day period). It is most commonly attached to Subclass 500 (student visas) and occasionally appears on other visa types.

Fortnight calculation: The fortnight period is any consecutive 14-day window — it is not fixed to calendar fortnights. If a student works more than 48 hours in any rolling 14-day period during their course, they breach condition 8105.

Exceptions: The 48-hour limit does not apply during officially scheduled course breaks. The break must be formally scheduled by the student's education institution — students cannot self-declare a break. During a genuine scheduled break, unlimited work is permitted.

Which visas: Condition 8105 is standard on all Subclass 500 (student) visas. It may also appear on Subclass 590 (student guardian), some Subclass 485 holders, and occasionally on other visas where Home Affairs determines a work limit is appropriate.

Penalties: Breaching condition 8105 can result in visa cancellation for the holder. Employers who knowingly allow or cause a breach can face civil penalties under the Migration Act 1958. VEVO clearly identifies condition 8105 when it is attached to a visa.

Condition Scope

Condition 8105 applies to all Subclass 500 student visas and may appear on other visa subclasses. Never assume a visa is free of 8105 — always check via VEVO.

The 48-hour limit applies to any consecutive 14-day window, not fixed calendar fortnights. Employers should track hours carefully across rolling two-week periods.

VEVO Detection

VEVO checks return condition 8105 status directly from the Home Affairs database. Refchecks flags this condition prominently in the work rights report.

Employer Compliance

Employers are legally required to verify work rights. Running a VEVO check and storing the result provides documented evidence of due diligence if a breach is later alleged.
